Where upon appeal, an action was remanded to the district court, with leave to a party to renew a motion for a new trial, which was then pending in such action in the district court, and the party thereafter prepared and presented a motion for a new trial, which incorporated the grounds urged in the original motion and also included other grounds additional thereto; the new motion was a renewal of the original motion, in so far as the grounds urged in the two motions were identical, but not a renewal with respect to grounds not mentioned in the original motion.
